Legal
Terms of Service.
These Terms of Service (“Terms”) are an agreement between you and MyloTech, Inc., a Delaware corporation doing business as MANstrual (“MANstrual,” “we,” “us,” or “our”), governing your access to MANstrual’s website, progressive web app, iOS app, forecasts, pairing, notifications, and related services (the “Service”).
These Terms contain a binding individual arbitration agreement and class-action waiver, with a 30-day right to opt out (section 9). Please read them carefully.
By selecting “Agree and continue” in MANstrual’s account-agreement step, you affirmatively agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains our information practices and consumer health data disclosures; acknowledging that policy is not a substitute for any separate consent required by law.
1. Eligibility and accounts
You must be at least 18 years old, legally able to enter a contract, and permitted to use the Service under applicable law. The Service is not offered to anyone under 18.
Provide accurate information, use one account only for yourself, keep your credentials confidential, and promptly tell us if you suspect unauthorized access. You are responsible for activity under your account to the extent permitted by law. MANstrual uses Clerk for identity and session management; Clerk’s applicable terms also govern that service.
You select a launch role labeled “Him” or “Her.” The labels control features and data access; they are not a statement about gender identity. You may change a role before pairing. After pairing, changing roles requires dissolving the pair and starting again.
2. Pairing and responsible sharing
The Service creates one private shared space between two adult accounts with complementary roles. Pair only with a person who has agreed to connect with you. Pairing invitations are short-lived, single-use, and must not be posted publicly or used to gain access without permission.
Her controls the wearable connection and partner sharing. While pairing is active, Him may receive the derived forecasts, approximate timing, normalized daily summaries, visible Comfort Kit content, and shared support-request status described in the Privacy Policy. Her can revoke sharing and dissolve the pair at any time. Cross-member access ends immediately after revocation, though a person may retain information they already saw or captured outside MANstrual.
Use shared information with care. Do not use MANstrual to surveil, coerce, control, shame, discriminate against, harass, or make decisions for another person. A forecast never replaces a direct conversation, and access to a forecast is not consent to intimacy, medical treatment, purchases, or any other action.
3. Forecasts, notifications, and third-party connections
Forecasts are estimates produced from manual anchors, available wearable observations, and a deterministic model. Cycle timing and body signals vary. Data may be missing, stale, delayed, corrected, or wrong, and a wearable or provider may be unavailable. Confidence, freshness, weather language, and support suggestions communicate uncertainty; they are not measurements or guarantees.
Her may connect a supported wearable through Junction. Junction and the wearable provider have their own terms and privacy practices. MANstrual is not responsible for their services, their source data, or an outage outside our control. Her may disconnect the wearable and continue with a manual anchor, with lower forecast confidence.
If you opt in, MANstrual may send account notifications, alerts before a forecast phase changes, and partner updates. None of them is an emergency alert. Notification delivery is not guaranteed and should never be used for urgent, safety-critical, or medical communication. You can change notification preferences in Settings and device permissions.
Comfort Kit links may open a retailer or search service. Except for concierge orders described below, MANstrual does not sell, order, deliver, warrant, or accept payment for those goods. The destination’s terms, prices, availability, returns, and privacy practices apply. Review the destination before completing a purchase.
Concierge orders
Where offered, Him may ask MANstrual to buy selected items from Her shared Comfort Kit and have them delivered (a “concierge order”). Prices shown before checkout are estimates based on typical U.S. delivery-app prices for the item and brand, plus an estimated MANstrual service fee and an estimated $9.99 for delivery and the shopper’s tip. They are not a retailer’s quote and may not match what the order costs on the day.
At checkout you authorize a hold on your card, not a charge. The hold is the estimated total plus 15% for sales tax and price changes, and is the most a concierge order can cost you. After a MANstrual operator places the order, you are charged the total on the store’s receipt (items, sales tax, the delivery service’s fees, and the shopper’s tip, which the store or delivery service has already collected and passes on at cost) plus a MANstrual service fee of 10% of that receipt total, at least $3. The charge never exceeds the hold; if it would, MANstrual absorbs the difference. The unused part of the hold is released, and if the order cannot be placed, the whole hold is released and you are not charged. When a released hold leaves your available balance depends on your card issuer. Payment is handled by Stripe, which also collects the delivery address and a phone number. MANstrual reads the address and phone number to place and deliver the order and does not keep them in its own database; Stripe keeps them under its own terms. Concierge orders deliver to U.S. addresses only.
After the hold is placed, a MANstrual operator places the order by hand with a third-party retailer or delivery service on your behalf. Brands, pack sizes, availability, and delivery times can differ from the estimate, and you see the final charge and any released amount in the app. MANstrual may substitute a close equivalent or leave out an item it cannot obtain, and you pay only for what is on the receipt. Her is told that comfort is on the way once the hold is placed. Concierge orders are for everyday comfort and personal-care products. They are not medical supplies and not an emergency service.
Delivery
Our goal is that a concierge order arrives within about three hours of the hold being placed (in the app: “Usually arrives in under 3 hours.”). That is a goal, not a guarantee: delivery depends on the retailer, the delivery service, the shopper, traffic, and the weather. If the retailer or delivery service requires it, someone 18 or older may need to receive the order and show ID.
Refunds, returns and problems
- Missing, wrong, or damaged items. Tell us through the support contact in the app’s Settings, or email benton@mylotech.org, within 48 hours of delivery. We refund that item’s cost on the receipt, plus its share of the MANstrual service fee, to the card you paid with.
- Late or failed delivery. If an order arrives very late or not at all, we refund it or order it again, at our choice. You are never charged for anything that did not arrive.
- Returns. Opened personal-care products can’t be returned, unless the law requires it.
- Cancelling. Until the operator places the order, contact support to cancel it and the whole hold is released. Once the order has been placed with the retailer, it can’t be cancelled, though the problems above are still covered.
- Card disputes. Please contact support before disputing a charge with your card issuer. Most problems are fixed faster that way, and it does not affect your right to dispute.
Refunds go back to the original card through Stripe. None of this limits any refund, cancellation, or other right you have under law.
4. Price, MANstrual Plus, and earlier subscriptions
MANstrual is free while you use it on your own: before you pair, and while Him tracks a cycle on his own. Optional concierge orders carry the charges described above.
MANstrual Plus
Where MANstrual Plus is offered, a pair that connects on or after the date MANstrual begins offering it needs an active MANstrual Plus subscription to use the Service together. A pair that connected before that date keeps access without one. Either member may subscribe, and one subscription covers the pair while the pair remains active.
MANstrual Plus is sold only as an auto-renewing subscription through Apple’s App Store in the iOS app, at the price, term, and any free trial shown before you confirm the purchase. Apple charges your Apple Account, and payment is collected when you confirm the purchase or, with a free trial, when the trial ends. The subscription renews automatically for the same term unless you cancel at least 24 hours before the end of the current period. You manage or cancel it in your Apple Account settings. Deleting your MANstrual account, or ending a pair, does not cancel an App Store subscription; cancel it with Apple to stop renewal. Apple handles refunds under its policies.
A subscription covers the pair it was bought for. If the pair ends, it stops covering the other member, and it never moves to another person’s account. If no member of a pair has an active subscription, the pair loses access to shared features until one subscribes again. Your information is kept as described in the Privacy Policy, and privacy, deletion, wearable, sharing, pairing, and sign-out controls stay available without a subscription.
Before September 25, 2026, MANstrual offered a paid shared plan through Stripe. A subscription started then continues under the terms shown when it was purchased until it is canceled. The member who started it, or the other member of the pair, can cancel it at any time in Settings through the Stripe customer portal. Deleting an account cancels an associated subscription as part of deletion, and revoking a pair schedules the shared subscription to end. Charges already paid are nonrefundable except where law requires otherwise or a purchase disclosure says otherwise; this does not limit any nonwaivable refund, cancellation, or cooling-off right.
If MANstrual offers a paid feature in the future, we will show its price and terms before you choose it, and we will not charge you without your express agreement.
5. Your content and acceptable use
Your content
You keep ownership of content you submit, such as Comfort Kit names, photos, and shopping links. You give MANstrual a nonexclusive, worldwide, royalty-free license to host, copy, process, resize, display, and transmit that content only as needed to operate, secure, and improve the Service and meet legal obligations. The license ends when the content is deleted, except for temporary backups and records lawfully retained under the Privacy Policy.
Only submit content you have the right to use. Do not upload another person’s private or health information, unlawful content, malicious files, or content that infringes intellectual-property or privacy rights. MANstrual may remove content that violates these Terms or creates a security or legal risk.
Prohibited conduct
You may not:
- access or attempt to access another account, pair, provider connection, or nonpublic system without authorization;
- circumvent access controls, rate limits, sharing revocation, billing controls, or security measures;
- use the Service to stalk, monitor, coerce, harass, discriminate, or cause harm;
- scrape, harvest, sell, or commercially exploit another person’s data;
- introduce malware, interfere with the Service, probe it without written authorization, or overload it;
- reverse engineer or copy the Service except where applicable law expressly permits it; or
- use the Service unlawfully or help another person violate these Terms.
6. Service ownership, feedback, and availability
MANstrual and its licensors own the Service, including its software, design, branding, forecast presentation, and other materials, excluding your content. Subject to these Terms, MANstrual grants you a limited, personal, nonexclusive, nontransferable, revocable license to use the Service for its intended noncommercial purpose.
If you send product feedback, you allow MANstrual to use it without restriction or compensation, but this does not grant us a right to use personal or consumer health data outside the Privacy Policy.
We may maintain, update, add, remove, suspend, or discontinue features. We will try to give reasonable notice if a change materially reduces the Service, unless an urgent security, legal, or provider issue makes advance notice impractical. The Service may experience outages or delays. We do not promise uninterrupted availability, permanent storage, or compatibility with every browser, device, wearable, or provider.
7. Suspension, termination, and account deletion
You may stop using the Service, cancel an earlier subscription, revoke a pair where the controls permit, or request account deletion at any time. These actions have different effects; review the confirmation shown before proceeding.
MANstrual may suspend or terminate access if reasonably necessary to protect a person or the Service, respond to fraud or a security event, comply with law or provider requirements, or enforce a material violation of these Terms. Where practical, we will give notice and an opportunity to correct the issue. Suspension never removes access to privacy, deletion, or subscription-cancellation controls.
When these Terms end, your license ends. Provisions that by their nature should survive—including ownership, payment obligations already incurred, warranty disclaimers, liability limits, dispute terms, and general provisions—remain in effect. Information is handled after termination as described in the Privacy Policy.
8. Disclaimers and limits on liability
Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” MANstrual disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that a forecast, recommendation, provider observation, retailer link, notification, or other content will be accurate, complete, current, available, or appropriate for your circumstances.
Some jurisdictions do not allow particular warranty disclaimers. In those places, the disclaimers apply only to the extent permitted, and you retain nonwaivable consumer rights.
Limitation of liability
To the fullest extent permitted by law, MANstrual and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or relationships, arising from the Service or these Terms, even if advised that such damage was possible.
To the fullest extent permitted by law, their total aggregate liability for all claims arising from the Service or these Terms will not exceed the greater of $100 USD or the amount you paid MANstrual during the 12 months before the event giving rise to the claim.
These limits do not apply to liability that cannot lawfully be limited, and they do not limit rights under applicable privacy, consumer-protection, product-liability, or other mandatory law.
Indemnity
To the extent permitted by law, you agree to defend and indemnify MANstrual from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the Service, your violation of another person’s rights, or content you submit. This obligation does not apply to the extent a claim results from MANstrual’s own conduct.
9. Dispute resolution, arbitration, and class-action waiver
Please read this section carefully. It affects your rights.
Informal resolution first
Before filing a claim, you agree to try to resolve it with us informally by emailing legal@mylotech.org with a description of the dispute and the relief you seek. Both parties agree to negotiate in good faith for 30 days before starting a formal proceeding.
Binding arbitration
If we cannot resolve it informally, you and MyloTech, Inc. agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in the county where you live or by videoconference, and the arbitrator may award the same individual relief a court could.
Class-action waiver
You and we each waive the right to bring or participate in a class, collective, or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
Carve-outs
Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property.
10. Governing law and general terms
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to section 9, the state and federal courts located in Delaware have exclusive jurisdiction over any dispute not subject to arbitration. Nothing here takes away a protection that the law where you live does not allow to be waived.
Changes to these Terms
MANstrual may update these Terms as the Service or law changes. We will update the date above and give additional notice before a material change takes effect. If law requires renewed assent, we will ask for it. Changes do not retroactively alter a dispute that arose before the change. If you do not agree to updated Terms, stop using the Service before they take effect. You can still delete your account.
Electronic communications
You agree that account notices, disclosures, and records may be provided electronically through the Service or the email associated with your account. You may keep a copy of these Terms. Notification preferences do not prevent legally required or essential account messages.
Other terms
These Terms, any purchase disclosures shown for an earlier subscription, and any additional terms presented for a particular feature are the entire agreement about the Service. If terms conflict, the more specific terms govern that feature. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not transfer your account or these Terms. MANstrual may assign these Terms as part of a corporate transaction or by operation of law, subject to the Privacy Policy and applicable law. There are no third-party beneficiaries to these Terms.
MANstrual is not responsible for delay caused by events reasonably outside its control, including provider outages, network failures, natural disasters, labor disputes, government action, or widespread security incidents.
